IDEOLOGI PANCASILA SEBAGAI DASAR MEMBANGUN NEGARA HUKUM DAN IMPLEMNTASI DI ERA REFORMASI INDONESIA
Abstract
This research examines Pancasila ideology as the foundation for building a state based on law and its implementation in Indonesia’s reform era. Pancasila serves as the source of all legal norms, providing philosophical, ethical, and juridical foundations for state governance. The concept of Indonesia’s rule of law differs from Western concepts of rechtsstaat and the rule of law, as it emerged from the struggle for independence against colonialism rather than opposition to monarchical absolutism. Using doctrinal legal research with a statutory approach, this study emphasizes that Pancasila is not only the foundation of the state but also the paradigm for development in education, politics, ideology, law, and national resilience. The findings indicate that implementing Pancasila in nation building during the reform era faces challenges from globalization, requiring a stronger understanding of Pancasila values to remain a guiding principle for the life of the nation and the state.
