PENERAPAN SANKSI PIDANA TERHADAP PELAKU TINDAK PIDANA CYBERSTALKING DI INDONESIA

Abstract

The development of increasingly sophisticated information technology as a means of communication and interaction between people. This technological development is often misused by individuals to commit acts that can disrupt the comfort and safety of others. Cyberstalking is an act carried out by someone via the internet or social media to send messages containing threats, harassment, and other actions that cause fear to others. This study uses a normative research method by reviewing laws and other literature to understand the issue being investigated by the author. Furthermore, the legal basis used to combat internet-based crimes, so far, there are still no specific regulations governing cyberstalking and still rely on the Information and Electronic Transactions Law and the Criminal Code. Therefore, there is a need for specific regulations governing cyberstalking to provide strict sanctions for perpetrators.
