DISKRESI PEJABAT PUBLIK DALAM PELAYANAN PERIZINAN BERUSAHA BERBASIS OSS RISK BASED APPROACH
Abstract
Business licensing services based on the Online Single Submission Risk-Based Approach (OSS-RBA) are designed to simplify the licensing process and increase legal certainty for businesses. However, in practice, the implementation of OSS-RBA still involves the discretion of public officials, particularly in the verification process, risk assessment, and administrative decision-making. This study aims to analyze the forms and limits of public officials' discretion in OSS-RBA-based business licensing services and their implications for the principle of government accountability. The research method used is normative legal research with a statutory and conceptual approach. The results show that although OSS-RBA is digital and standardized, room for official discretion remains and has the potential to give rise to legal issues if not clearly defined. Therefore, strengthening oversight and legal accountability mechanisms is necessary to ensure accountable licensing services that comply with the principles of good governance.
