PERAN DAN TANGGUNG JAWAB NOTARIS DALAM MENJAMIN KEPASTIAN HUKUM ATAS PERALIHAN HAK ATAS TANAH DI INDONESIA
Abstract
Notaries hold a strategic role within the Indonesian legal system, particularly in ensuring legal certainty over the legal acts of the public. One of the most critical areas is the transfer of land rights, which involves the authority of notaries and the Land Deed Official (Pejabat Pembuat Akta Tanah or PPAT). This article provides a comprehensive discussion on the role, authority, and responsibilities of notaries in the process of land rights transfer, including the relationship of their authority with PPAT, practical challenges in the field, and the legal implications in the event of violations. The research method employed is normative legal research with a statutory and conceptual approach. The findings indicate that notaries play a central role in ensuring legal certainty; however, they still face various challenges from both regulatory and practical perspectives. Therefore, there is a need to strengthen legal understanding and professional ethics to maintain public trust in the notary profession.
