IMPLIKASI NOTARIS YANG DIBERHENTIKAN SEMENTARA DAN DIBERHENTIKAN DENGAN TIDAK HORMAT
Abstract
Notaries are public officials who possess attributed authority from the state to create authentic deeds in order to ensure legal certainty for the public. However, the integrity of this position can be compromised if a Notary commits legal or ethical violations that lead to administrative sanctions. This study analyzes the legal implications for the authority of the office and the evidentiary strength of deeds for Notaries who are subject to sanctions of temporary dismissal compared to dishonorable dismissal (PDTH). Using a normative legal research method with literature analysis, it was found that dismissal sanctions result in an immediate loss of the Notary's legal capacity, whether in the form of functional suspension (temporary) or permanent termination (PDTH). The fatal implication is the degradation of the deed's evidentiary strength into a private deed for deeds processed during the sanction period. Therefore, a swift and transparent protocol handover mechanism is required to protect the civil rights of the public using Notary services.
